1. Scope and who we are
For purposes of this website, MOTOMA means MOTOMA Energy and the MOTOMA group
entity responsible for the relevant website, inquiry, quotation, order,
warranty registration, technical support request or other interaction.
Depending on the circumstances, that entity may act as the controller,
business, responsible party or equivalent term under applicable privacy law.
This policy applies to personal information collected through our public
websites and related online forms. It does not replace employee, applicant,
distributor, supplier or customer notices that may apply to a separate
business relationship.
2. Information we collect
Depending on how you interact with us, we may collect the following categories of information:
- Identity and contact information: name, company, job title, country or region, city, email address, telephone or mobile number and preferred language.
- Business and inquiry information: project requirements, requested products, quotation details, distributor or customer status, communications and other information you choose to provide.
- Product, warranty and service information: product model, serial or lot number, purchase date, installation information, system configuration, fault descriptions, diagnostic information, warranty status and service history.
- Files you upload: product label photos, installation photos, screenshots, documents, PDFs and short videos submitted for support, quality, warranty or troubleshooting purposes.
- Website and device information: IP address, browser type, device type, operating system, referring page, pages viewed, approximate location derived from IP address and technical logs used to operate and secure the website.
- Preferences: newsletter subscription status, language selection, cookie choices and other communication preferences.
Please do not submit sensitive personal information, government identification,
financial account credentials, health information or other data that is not
necessary for your request unless we specifically ask for it and provide an
appropriate notice.
3. How we use information
We may use personal information to:
- respond to sales, product, technical and general inquiries;
- prepare quotations, project configurations and pre-sales recommendations;
- process warranty registrations, warranty verification and after-sales support requests;
- diagnose battery, BMS, inverter, energy-storage-system and solar-product issues;
- communicate about service cases, shipping, replacement parts, repairs, returns or other support actions;
- manage customer, distributor, supplier and business relationships;
- send newsletters or marketing communications where permitted by law;
- operate, maintain, localize, secure and improve our websites and forms;
- detect fraud, abuse, cybersecurity threats or misuse of our systems;
- comply with legal, regulatory, accounting, tax, product-safety, trade-control and recordkeeping obligations; and
- establish, exercise or defend legal claims.
4. Legal bases for processing
Where laws such as the EU GDPR or UK GDPR require a legal basis, we rely on one
or more of the following, depending on the purpose:
- Contract or pre-contract steps: when you ask for a quotation, purchase information, project support, warranty service or other action related to a potential or existing transaction.
- Legitimate interests: to operate and secure our business, respond to business inquiries, improve services, prevent fraud, maintain records and support customers, where those interests are not overridden by your rights.
- Legal obligation: when processing is required by applicable law, regulation, court order, tax, customs, product-safety or compliance requirements.
- Consent: where required for marketing, non-essential cookies or another specific activity. You may withdraw consent at any time, without affecting processing that occurred before withdrawal.
5. Cookies, local storage and similar technologies
Our website may use cookies, browser local storage and similar technologies to
provide essential functionality, remember language or preference settings,
maintain security and, where enabled, understand website performance.
Where applicable law requires consent for non-essential cookies or similar
technologies, we will request consent before using them. You can also manage
cookies through your browser settings. Blocking strictly necessary technologies
may affect website functionality.
6. Sharing and service providers
We may disclose personal information only as reasonably necessary to:
- MOTOMA group companies, branches, authorized sales or service teams that need the information to handle your request;
- website hosting, cloud, email, cybersecurity, file-storage, CRM, analytics, logistics, payment, customer-support and other service providers acting on our behalf;
- authorized distributors, installers, repair partners or technical partners where needed to fulfill a request or service case;
- professional advisers such as auditors, insurers, lawyers and accountants;
- government authorities, regulators, courts or law-enforcement bodies where disclosure is legally required or reasonably necessary to protect rights, safety or security; and
- a buyer, investor or successor in connection with a merger, acquisition, financing, restructuring or sale of all or part of a business, subject to appropriate safeguards.
We do not knowingly sell personal information for monetary consideration.
If a data practice constitutes a "sale" or "sharing" under an applicable
privacy law, we will provide the notices and opt-out mechanisms required by
that law.
7. International data transfers
MOTOMA operates internationally. Your information may therefore be processed
in countries other than the country where you live, including locations where
MOTOMA group companies or service providers operate.
Where required, we use legally recognized transfer mechanisms and appropriate
safeguards, such as contractual protections, approved standard contractual
clauses or other measures permitted by applicable law.
8. Data retention
We retain personal information only for as long as reasonably necessary for
the purposes described in this policy, including to complete inquiries,
maintain warranty or service records, comply with legal and accounting
requirements, resolve disputes and enforce agreements.
Retention periods vary by record type, product warranty period, contractual
relationship, applicable limitation period, regulatory obligation and
technical need. When information is no longer required, we will delete,
anonymize or securely dispose of it where reasonably practicable.
9. Security
We use reasonable administrative, technical and organizational safeguards
designed to protect personal information against unauthorized access,
disclosure, alteration, loss or misuse. These measures may include access
controls, system monitoring, security procedures, vendor controls and
appropriate transmission or storage protections.
No website, transmission method or storage system can be guaranteed to be
completely secure. You should avoid sending passwords, financial credentials
or other unnecessary sensitive information through general inquiry forms.
10. Your privacy rights and choices
Depending on your location and applicable law, you may have rights to request
access to personal information, correction, deletion, restriction of
processing, data portability, or to object to certain processing. You may
also have the right to withdraw consent and to complain to a competent data
protection authority.
California residents may have additional rights, including rights to know,
access, correct or delete personal information, to opt out of certain sale or
sharing of personal information, to limit certain uses of sensitive personal
information where applicable, and to exercise privacy rights without unlawful
discrimination.
You may unsubscribe from marketing emails by using the unsubscribe mechanism
provided in the message or by contacting us. Where applicable law requires us
to recognize a legally valid browser-based opt-out preference signal, we will
process that signal as required.
We may need to verify your identity before completing a rights request. We
may also deny or limit a request where permitted or required by law, including
where fulfilling the request would adversely affect the rights of another person.
11. Warranty, technical support and after-sales submissions
Technical and after-sales support for lithium batteries, battery management
systems, inverters, energy storage systems and solar products may require
detailed product information, photographs, diagnostic records or video.
Please submit only information that is relevant to the technical issue.
If an uploaded image or video contains people, vehicle registrations, home
interiors, customer records, computer screens or other personal information,
you are responsible for ensuring that you are authorized to provide that
information to us. We may share relevant technical materials with qualified
service personnel, manufacturers, laboratories, logistics providers or
authorized service partners when reasonably necessary to investigate or
resolve the case.
12. Children
Our website and business-to-business products are not directed to children.
We do not knowingly collect personal information from children in circumstances
where parental or guardian consent is legally required. If you believe a child
has provided personal information to us improperly, please contact us.
13. Third-party websites and services
Our website may contain links to distributors, social media platforms,
logistics services, video platforms, mapping services or other third-party
websites. Their privacy practices are governed by their own notices, and we
are not responsible for third-party privacy practices.
14. Changes to this Privacy Policy
We may update this Privacy Policy to reflect changes in our business,
technologies, legal requirements or data practices. The "Last updated" date
will show when the policy was most recently revised. Where required by law,
we will provide additional notice of material changes.
