1. Acceptance of these Terms
You may use this website only if you are legally capable of agreeing to these Terms and your use is permitted by applicable law. If you access the website on behalf of a company or other organization, you represent that you are authorized to act on its behalf.
If you do not agree to these Terms, please do not use the website.
2. Scope
These Terms apply to MOTOMA‘s public websites and website-based resources, including information relating to lithium batteries, LiFePO4 batteries, battery management systems (BMS), battery energy storage systems (BESS), inverters, solar panels, accessories, project solutions, warranty support, downloads, news, case studies and technical or sales inquiries.
Separate terms may apply to online portals, software, applications, monitoring platforms, customer accounts, distributor platforms or services that are governed by another agreement.
4. Technical information is not a substitute for professional engineering or safety advice
Website content is provided for general product and business information. It is not a substitute for a site-specific electrical design, fire-safety assessment, structural assessment, installation plan, code review or other professional engineering service.
Installation, commissioning, maintenance, troubleshooting and modification of electrical and energy-storage equipment should be performed only by appropriately trained and qualified personnel in accordance with the applicable product manual, labels, technical documents and local laws, electrical codes, fire codes, building rules and utility requirements.
5. Lithium battery and energy-storage safety
Lithium batteries and energy storage systems can contain significant stored electrical energy and may present risks including electric shock, short circuit, arc flash, overheating, fire, gas release, chemical exposure or other hazards if they are damaged, incorrectly transported, improperly installed, misused or serviced by unqualified persons.
You must:
- follow the current product manual, safety instructions, warning labels and specified operating limits;
- use only compatible batteries, inverters, BMS components, chargers, cables, protection devices and accessories;
- observe specified temperature, ventilation, clearance, grounding, overcurrent-protection and environmental requirements;
- not open, puncture, crush, burn, short-circuit, immerse, bypass safety devices, modify firmware or otherwise alter products except where expressly authorized;
- stop using equipment that shows signs of swelling, leakage, impact damage, unusual heat, odor, smoke, corrosion, water ingress or other abnormal conditions and follow the applicable emergency and service procedures; and
- comply with local rules for storage, emergency response, recycling and disposal.
Information on this website does not override the product manual or any mandatory safety requirement.
6. Quotations, orders and contracts
Submitting a website inquiry, configuration request, warranty request or purchase request does not by itself create a contract or obligate MOTOMA to supply products or services.
Orders are subject to acceptance by the relevant MOTOMA entity or authorized seller. Product prices, payment terms, delivery terms, Incoterms, lead times, taxes, customs duties, minimum order quantities, technical scope and other commercial terms are governed by the applicable quotation, pro forma invoice, purchase agreement, sales terms or other written transaction document.
7. Warranty and after-sales service
Product warranties are governed by the warranty terms applicable to the specific product, model, country, seller and transaction. Statements on the website are summaries only and do not extend, replace or modify a written product warranty.
Warranty coverage may depend on proper installation, use, maintenance, environmental conditions, system compatibility, proof of purchase, serial number, service records and compliance with warranty procedures. Damage caused by misuse, unauthorized modification, improper installation, incompatible equipment, abnormal operating conditions, accident, transport damage or other excluded causes may not be covered.
After-sales troubleshooting recommendations are based on the information supplied by the user and do not guarantee a particular diagnosis or outcome. MOTOMA may request additional product labels, photographs, logs, test results or videos before determining the appropriate support action.
8. User submissions and uploaded materials
When you submit text, files, photographs, videos, drawings, project data, diagnostic information or other materials, you represent that you have the right to provide them and that doing so does not violate another person‘s rights or applicable law.
You grant MOTOMA a non-exclusive, worldwide, royalty-free right to use, reproduce, transmit and internally share submitted materials only as reasonably necessary to respond to your request, provide support, investigate product or quality issues, improve service processes, comply with law or protect legal rights.
Do not upload malicious code, confidential information belonging to a third party without authorization, or unnecessary sensitive personal information.
9. Acceptable use
You may not:
- use the website for unlawful, fraudulent, deceptive or abusive activity;
- attempt to gain unauthorized access to the website, servers, accounts, forms or connected systems;
- introduce malware, automated attack traffic or other harmful code;
- scrape, crawl or extract website data at a scale that interferes with website operation or violates applicable law;
- impersonate MOTOMA, an employee, distributor, customer or another person;
- remove copyright, trademark, confidentiality or proprietary notices; or
- use website content to create misleading product claims, counterfeit materials or false certification statements.
10. Intellectual property
The website and its text, graphics, logos, product names, photographs, videos, drawings, downloadable materials, interface elements and other content are owned by or licensed to MOTOMA and are protected by intellectual property laws.
MOTOMA grants you a limited, revocable, non-exclusive, non-transferable right to access and use public website content for legitimate personal or business evaluation purposes. No ownership rights are transferred to you.
You may not reproduce, publish, modify, distribute, sell, sublicense or use MOTOMA content for commercial promotion without prior permission, except to the extent expressly permitted by law or by a written MOTOMA authorization.
11. Third-party content and links
The website may link to third-party websites, social media, video platforms, mapping services, distributors, logistics providers or other services. MOTOMA does not control those services and is not responsible for their availability, content, security, terms or privacy practices.
12. Export, import, transport and environmental compliance
Products, technical information and transactions may be subject to export controls, sanctions, customs rules, import licensing, dangerous-goods transport rules, battery shipping requirements, recycling laws, extended producer responsibility requirements and other local or international regulations.
Lithium batteries may be regulated as dangerous goods for air, sea, road or rail transport. The party arranging shipment is responsible for confirming classification, packaging, marking, labeling, documentation, carrier requirements and other obligations applicable to the shipment.
You are responsible for determining whether a product may lawfully be imported, installed, connected, operated, resold, transported, recycled or disposed of in the intended market unless MOTOMA has expressly agreed in writing to assume a specific compliance responsibility.
13. Disclaimers
To the fullest extent permitted by law, the website and public website content are provided on an "as is" and "as available" basis. MOTOMA does not guarantee that the website will be uninterrupted, error-free, secure or suitable for every intended application.
Nothing in these Terms excludes any warranty, guarantee, right or remedy that cannot lawfully be excluded under applicable consumer or other mandatory law.
14. Limitation of liability
To the fullest extent permitted by applicable law, MOTOMA will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business opportunity, data or goodwill, arising solely from use of or inability to use the public website.
These website limitations do not replace or change liability provisions in a signed sales agreement, product warranty or other transaction-specific contract, and they do not limit liability that cannot legally be limited or excluded.
15. Changes to the website or these Terms
We may update website content, features or these Terms from time to time. The "Last updated" date shows the most recent revision. Continued use of the website after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.
16. Governing rules and disputes
These website Terms are subject to the mandatory laws applicable to the website operator and to you. Where a separate quotation, order, sales contract, distributor agreement, warranty or other written agreement contains a governing-law or dispute-resolution clause, that clause controls disputes relating to that agreement or transaction.
Nothing in these Terms removes rights or remedies that cannot be waived under applicable law.
